Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Zeeng Sports, LLC, a Kansas limited liability company doing business as FLYTE ("FLYTE", "we", "us", or "our"), with its principal place of business in Overland Park, Kansas, USA.
By accessing or using our website at flytegolf.ai (the "Website"), downloading or using the FLYTE mobile application (the "App") available on the Apple App Store or Google Play Store, purchasing or using FLYTE hardware (the "Device" or "Radar"), or subscribing to any FLYTE service (including AI coaching, community features, or membership plans), you agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, do not access or use the Website, App, or any FLYTE services or hardware.
Your use of the FLYTE App is also subject to the Apple Media Services Terms and Conditions and Apple App Store Review Guidelines (for iOS devices) and the Google Play Terms of Service and Developer Distribution Agreement (for Android devices), as applicable. These third-party terms are incorporated by reference. In the event of any conflict between those third-party terms and these Terms, these Terms shall control solely with respect to FLYTE’s services, content, and hardware.
Description of Services
FLYTE provides a performance platform for golfers that includes:
Precision Doppler radar hardware (the "FLYTE Golf Radar" or "Device") designed for real-time swing and ball flight data.
Mobile application featuring AI-powered coaching, swing analysis, personalized improvement plans, and community features ("Crew").
Subscription-based membership plans that may include hardware access, AI coaching, community features, and other services.
Website content, marketing materials, waitlist, and affiliate/creator programs.
FLYTE uses only publicly available data and publicly reported benchmarks in its coaching features and any performance comparisons. We do not access, use, or rely on any proprietary or non-public datasets from the PGA, LPGA, or any other governing body or third-party agency.
Accounts & Eligibility
You must be at least 13 years old (or the applicable age of digital consent in your jurisdiction) to create an account or use the App. By creating an account, you represent that you are legally able to enter into this agreement.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.
FLYTE reserves the right to refuse service, terminate accounts, or cancel subscriptions at its sole discretion for violation of these Terms or for any other lawful reason.
Pricing, Subscriptions & Billing
You must be at least 13 years old (or the applicable age of digital consent in your jurisdiction) to create an account or use the App. By creating an account, you represent that you are legally able to enter into this agreement.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.
FLYTE reserves the right to refuse service, terminate accounts, or cancel subscriptions at its sole discretion for violation of these Terms or for any other lawful reason.
Hardware, Products & Limited Warranty
The FLYTE Golf Radar is a precision Doppler device developed in partnership with Ainstein and manufactured to high standards. Accuracy claims (within 1–3% of TrackMan on validated metrics) are based on internal testing and are not guarantees for every use case or environment.
Limited Warranty: FLYTE warrants the Device against defects in materials and workmanship for twelve (12) months from the date of original shipment or activation (whichever is later). This warranty does not cover damage from misuse, abuse, unauthorized modification, water damage beyond IP67 rating, or normal wear.
Warranty claims must be submitted through the App or support channels with proof of purchase/activation. Remedies are limited to repair or replacement at FLYTE’s option.
Software updates, firmware, and feature access for the Device are provided via the App and may require an active subscription.
Intellectual Property
All content on the Website and App, including but not limited to text, graphics, logos, button icons, images, audio clips, data compilations, software, and the compilation thereof, as well as all trademarks, service marks, and trade names, are the property of FLYTE or its licensors and are protected by United States and international intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of our services or content without our prior written permission, except as expressly permitted in these Terms.
The FLYTE Golf Radar hardware, firmware, golf-specific algorithms, calibration methods, AI models, and all related intellectual property are owned exclusively by FLYTE (subject to any retained rights by manufacturing partners as disclosed in our agreements).
User Content License. By posting, uploading, submitting, or sharing any content, data, swing videos, comments, or other materials through the App, Website, or community features (including Crews), you grant FLYTE a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, host, store, cache, reproduce, modify, adapt, publish, distribute, and display such content solely for the purpose of operating, developing, improving, and promoting the FLYTE services. You represent that you own or have all necessary rights to grant this license.
Data and Performance Information Ownership. You retain ownership of your personal data and any original swing videos or content you upload. However, FLYTE exclusively owns all right, title, and interest in and to: (i) all aggregated, anonymized, and de-identified data derived from user activity; (ii) all swing, ball flight, and performance metrics, statistics, and derivative insights generated through the Device and App; and (iii) all improvements, enhancements, and derivatives to our AI models, algorithms, and services created using such data. By using the Device and App, you grant FLYTE a perpetual, irrevocable, worldwide, royalty-free license to use, analyze, and incorporate de-identified performance data into our products and AI training, even after termination of your account or these Terms. This license survives account deletion to the extent necessary for model improvement and service integrity. Your personal data rights are governed by our Privacy Policy and applicable law (including GDPR and applicable U.S. state privacy laws).
User Conduct & Community Guidelines
You agree not to misuse the FLYTE services. Prohibited conduct includes, but is not limited to:
Violating any applicable law or regulation
Infringing the rights of others
Uploading false, misleading, or harmful content
Attempting to reverse engineer, decompile, or extract source code from the App or Device firmware
Creating multiple accounts to circumvent restrictions or for abusive purposes
Harassing other users or disrupting community features (Crews, leaderboards, etc.)
FLYTE may remove content and suspend or terminate accounts that violate these guidelines.
Privacy
Your use of the Website, App, and services is also governed by our Privacy Policy, which describes how we collect, use, and share your information, including swing data, performance metrics, and location information from the Device.
By using FLYTE, you consent to the data practices described in the Privacy Policy. Swing and performance data is central to delivering AI coaching and community features.
Disclaimers & No Warranty
THE WEBSITE, APP, DEVICE, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
FLYTE does not warrant that the services will be uninterrupted, error-free, secure, or accurate. The App, AI coaching features, swing analysis, improvement plans, benchmarks, and any performance data or recommendations are provided for informational and entertainment purposes only. They are not a substitute for professional golf instruction, coaching, or medical advice. FLYTE makes no representations or warranties regarding the accuracy, reliability, or completeness of any data, metrics, AI-generated feedback, or coaching suggestions. You assume all risk associated with your use of the Device, App, and any resulting golf activities.
Hardware performance and accuracy can be affected by environmental conditions, ball type (including non-RCT balls), mounting position and stability, user technique, firmware version, and other factors. Any published validation or comparison data reflects testing under controlled conditions and does not constitute a guarantee of performance in all environments or use cases.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLYTE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OR INABILITY TO USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY; (C) UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS; OR (D) ANY BUGS, VIRUSES, OR OTHER HARMFUL CODE.
IN NO EVENT SHALL FLYTE’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS, THE SERVICES, HARDWARE, OR APP EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO FLYTE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100). THE FOREGOING LIMITATIONS SHALL APPLY EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE AND REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE).
Termination
We may suspend or terminate your access to the services at any time for violation of these Terms, non-payment, suspected fraud, or as otherwise permitted by law. Upon termination, your right to use the services ceases immediately.
Certain provisions (IP, disclaimers, limitation of liability, governing law, etc.) survive termination.
Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Kansas, United States of America, without regard to its conflict of law principles.
Any dispute arising out of or relating to these Terms or the services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved exclusively in the state or federal courts located in Johnson County, Kansas, and you consent to the personal jurisdiction of such courts.

Changes to These Terms
FLYTE may modify these Terms from time to time. We will provide notice of material changes by posting the updated Terms on the Website, through the App, or by email. Your continued use of the services after the effective date of the changes constitutes acceptance of the updated Terms.

Pricing, Subscriptions & Billing
FLYTE offers flexible pricing models for its hardware, software, and services. We may, at our sole discretion and at any time, offer hardware for separate purchase, subscription-only plans, hybrid models (hardware bundled with membership), usage-based pricing, per-unit fees, or any combination thereof. We reserve the right to introduce, modify, or discontinue any pricing plans, tiers, or billing structures without prior notice, except as required by applicable law.
Current pricing, available plans, and what is included with each option are displayed during signup, in the App, or on the Website. By completing a purchase or starting a subscription, you agree to the specific terms and pricing presented to you at that time.
Billing & Auto-Renewal: Subscriptions and recurring plans automatically renew at the end of each billing period unless you cancel. You authorize FLYTE (or its payment processor) to charge the payment method on file for all applicable fees.
Cancellation: You may cancel recurring subscriptions or plans at any time through your account settings or by contacting support. Cancellation is effective at the end of the current billing period. We generally do not provide prorated refunds for partial periods, except where required by law or at FLYTE’s sole discretion.
Hardware Provided with Memberships: When hardware is included as part of a membership or promotional plan, ownership and return obligations (if any) are governed by the specific terms presented at signup or in the applicable plan details. Promotional or seeded hardware may be subject to separate terms communicated at the time of receipt.

IN NO EVENT SHALL FLYTE’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS, THE SERVICES, HARDWARE, OR APP EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO FLYTE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100). THE FOREGOING LIMITATIONS SHALL APPLY EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE AND REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE).
Termination
We may suspend or terminate your access to the services at any time for violation of these Terms, non-payment, suspected fraud, or as otherwise permitted by law. Upon termination, your right to use the services ceases immediately.
Certain provisions (IP, disclaimers, limitation of liability, governing law, etc.) survive termination.
Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Kansas, United States of America, without regard to its conflict of law principles.
Any dispute arising out of or relating to these Terms or the services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved exclusively in the state or federal courts located in Johnson County, Kansas, and you consent to the personal jurisdiction of such courts.

Changes to These Terms
FLYTE may modify these Terms from time to time. We will provide notice of material changes by posting the updated Terms on the Website, through the App, or by email. Your continued use of the services after the effective date of the changes constitutes acceptance of the updated Terms.
